Lestock Man and Company Fined $11,200 for Failing to Comply With an Order to Maintain Ditch Blocks

A man and his company have been fined $11,200 in Wynyard Provincial Court for failing to comply with an order from the Water Security Agency (WSA).
  
Gerald Faye of Lestock was convicted under The Water Security Agency Act for failing to comply with an order to construct and maintain ditch blocks.  GJMK Farms, owned by Mr. Faye, was also fined as a result of the same circumstances.  Both fines are subject to a 40 per cent victim surcharge bringing the total amount of fines to $11,200. 

The charges were laid after a formal drainage complaint was made against Mr. Faye in 2007.  As a result of the complaint WSA ordered Mr. Faye to construct and maintain 14 ditch blocks.  A subsequent investigation by Water Security Agency and Conservation Officers from the Ministry of Environment acting for the agency showed Mr. Faye failed to comply with the order.

“Draining water without the proper approvals can have an adverse impact on other landowners downstream,” Water Security Agency Executive Director of Integrated Water Services Jim Gerhart said.  “All landowners should seek out the proper approvals from the Water Security Agency before initiating drainage related work.”

Landowners considering a drainage project should contact their nearest Water Security Agency Regional Office to learn about conditions and begin the process of obtaining approval from the agency.

The Water Security Agency was created to lead implementation of the 25 Year Saskatchewan Water Security Plan.  The plan will improve water management capacity and service to individuals, businesses and communities across Saskatchewan.  The agency brings together all of the major responsibilities related to water quality and quantity.
