CONSTRUCTION CONTRACTORS, EMPLOYEES FINED FOR SAFETY VIOLATIONS

A Manitoba contractor, David Nicholson of Dave's Do It Right Construction has pleaded guilty to three counts under the Occupational Health and Safety (OHS) Act related to failure to utilize a fall protection system and protective headwear and failure to sufficiently and competently supervise work. Carlyle Provincial Court imposed a $2,040 fine.

The charges related to a routine inspection of a construction site near Carlyle Airport in July 2010. Workers were observed on the rafters of a new building without fall protection or approved headwear. Two other charges against Nicholson were stayed.

A supervisor for Dave's Do It Right Construction also pleaded guilty to one count under the OHS Act for failure to ensure workers under his direction complied with the OHS Act. He was fined $840. Four other charges against him were stayed. As well, seven workers with the company each pleaded guilty to one count under the OHS Act for failing to utilize fall protection. The court fined each worker $580 for a total of $4,060.

In another case, MPM Construction Services Ltd. of Regina pleaded guilty to one count under the OHS Act related to failure to utilize a fall protection system. The company was fined $840.

The charge related to a routine inspection of a Regina worksite by an Occupational Health officer in December 2010. Workers were observed on the roof of a residence under construction without fall protection. Two other charges against the company were stayed.

An MPM Construction Services Ltd. supervisor also pleaded guilty to one count under the OHS Act for failure to ensure workers used a fall protection system at a work area and was fined $300. The court stayed charges against two workers from the company.

Injuries caused by falls represent almost 13 per cent of all workplace injuries reported. OHS has a zero tolerance approach to violations of fall protection.
