TWO CONSTRUCTION COMPANIES CONVICTED OF SAFETY VIOLATIONS AT SEPARATE WHITE CITY CONSTRUCTION SITES

Released on March 31, 2011

Two separate companies, Momentum Builders Inc. and Nick DiRuscio, conducting business as Western Framing, have pled guilty to charges under Saskatchewan's Occupational Health and Safety Act and have been fined a combined total of $2,760.

Momentum Builders Inc. was charged after a routine worksite inspection in September 2010. An Occupational Health Officer observed one worker on the roof who was not using fall protection. Momentum Builders Inc. was subsequently fined $840 for failure to use a fall protection system where a worker may fall three metres or more.

Three other charges against Momentum Builders Inc. were stayed.

Nick DiRuscio was charged after a routine inspection by an Occupational Health Officer at a residential construction worksite in White City in September 2010. DiRuscio pleaded guilty to four chargers under the Occupational Health and Safety Act related to failure to provide and require workers to use protective headwear and footwear, failure to use a fall protection system where a worker may fall three metres or more and failure to ensure workers were sufficiently and competently supervised at work. He was fined a total of $1,920.

One additional charge against DiRuscio for violating OHS regulations was stayed.

The OHS Division works to eliminate all workplace illnesses and injuries. OHS conducts about 4,000 worksite inspections annually to ensure standards are known, understood and enforced, and investigates where workers are killed or seriously injured in a work-related incident.
