DAVID AHENAKEW TO BE RETRIED FOR PROMOTING HATRED

The Public Prosecutions branch of the Saskatchewan Ministry of Justice and Attorney General today announced that David Ahenakew will be retried for wilfully promoting hatred under section 319(2) of the Criminal Code.

The charges arise out of remarks made by Ahenakew in an address to a conference in December 2002.

"Mr. Ahenakew was originally prosecuted because we believed that there was a reasonable likelihood of success and that it was in the public interest to do so," Public Prosecutions executive director Daryl Rayner said. "After careful consideration, we still believe this case meets that standard so we have decided to proceed with a new trial as ordered by the Court of Appeal."

Ahenakew was charged for wilfully promoting hatred in June 2003 and was convicted on July 8, 2005. He appealed to the Court of Queen's Bench and, on June 8, 2006, the decision was overturned and a new trial was ordered. The Crown appealed the matter to the Saskatchewan Court of Appeal and, on January 14, 2008, the appeal was dismissed.
