CONSTRUCTION COMPANY FINED FOR FAILING TO COMPLY WITH SAFETY STANDARDS

Brunner's Construction Ltd. of Saskatoon pled guilty to contravening occupational health and safety legislation and was fined $3,250 in Saskatoon Provincial Court. Travis Brunner, a supervisor for the company, was also fined $3,250.

Brunner's Construction was found guilty of violating section 262 of The Occupational Health and Safety Regulations, 1996 for failing to ensure protection from cave-ins or sliding material in an excavation, while Travis Brunner was found guilty of violating section 17(2) of the regulations for failing to ensure work under his direction was in compliance with occupational health and safety standards.

The company was charged following two worksite inspections during which an occupational health and safety inspector observed worksite excavations that were not adequately sloped to protect workers against cave-in. Travis Brunner was the supervisor at one worksite and was charged due to his reluctance to instruct workers to properly slope an excavation as per the occupational health and safety officer's request.

"Adherence to occupational health and safety standards prevents on-the-job injuries," Occupational Health and Safety Acting Assistant Deputy Minister Glennis Bihun said. "These standards are not optional. Flagrant disregard for the standards can result in prosecution."

The Occupational Health and Safety Division inspects approximately 4,000 workplaces annually and provides training to more than 4,000 employer and worker representatives each year on their safety rights and responsibilities.
