COMPANY FINED IN DEATH OF WORKER AT YORKTON

Insulation Applicators Ltd. of Regina, operating under the name Systems Scaffolding pleaded guilty Monday to charges under The Occupational Health and Safety Act, 1993 in connection with the death of a worker in Yorkton in 2004.

A total of $44,000 in fines and victim fine surcharges were levied by the court.

On October 20th, 2004, Blake Vance, a 40-year-old ironworker, died when the shoring supporting the roof of the Yorkton Agri-plex collapsed, pinning him under a roof beam.

Insulation Applicators Ltd. (Systems Scaffolding) was charged under Occupational Health and Safety Act, 1993, with contravening regulations, specifically: Section 195(1) - failure to ensure a temporary supporting structure can withstand safely all loads; and Section 195(2) - failure to ensure that the temporary supporting structure was designed, inspected after assembly and before use, or certified to be safe by a professional engineer.

Insulation Applicators Ltd. (Systems Scaffolding) was assessed a $34,400 fine and a $10,000 victim fine surcharge.

"These convictions send the message that there are repercussions for employers and workers who fail to comply with Occupational Health and Safety regulations," Occupational Health and Safety Division acting director Glennis Bihun said.

The Occupational Health and Safety Division inspects approximately 4,500 workplaces annually and provides training to more than 4,000 employer and worker representatives each year on their safety responsibilities.
