FIRM CONVICTED OF OCCUPATIONAL HEALTH & SAFETY VIOLATIONS

Released on November 24, 2003

A Saskatchewan firm was recently convicted in provincial court in Regina of four offences under the provincial Occupational Health and Safety (OH&S) Act and Regulations. The violator received a total of $1,300 in fines.

Legend Enterprises Inc./Jim's Sign Service was convicted of failing to ensure employees were wearing protective headgear, failing to ensure employees were not leaning over the side rails of ladders and failing to ensure workers were wearing fall protection equipment. As well, the firm was convicted of failing to report on progress after being provided with a notice of the contraventions by an Occupational Health Officer. The violations came to light as a result of routine inspections.

"These convictions send an important message about the need to follow occupational health and safety requirements," Occupational Health & Safety Division Executive Director Allan Walker said. "Flagrant disregard for OH&S regulations has consequences."

The maximum penalty under The Occupational Health and Safety Act for the offences in question is $40,000. Maximum penalties for an offence that causes the death or serious injury of a worker are $300,000 and two years in jail.
