The Surface Rights Board of Arbitration is used as a last resort when a landowner or occupant and an oil/gas or potash operator are unable to reach an agreement for surface access to private land and related compensation.

If an operator fails to honour its compensation obligations pursuant to a lease, an agreement respecting any of the rights set out in section 41 or an order issued pursuant to clause 33(2)(c), section 45 or any of subjections 50(2), 63(1), 79(1), or 85(3), an owner may apply to the Board under section 86.1 of the The Surface Rights Acquisition and Compensation Act . Landowners are advised to review the requirements of the Recovery of Compensation Application Form. Operators are advised to review the requirements of the Notice of Objection, including the statutory timeline in which an objection may be filed.
