Three Construction Companies Guilty of Safety Violations

Clay M. Nelson, operating as CMN Construction of Swift Current, pleaded guilty to two charges under occupational health and safety legislation and was fined $1,040 in Swift Current Provincial Court on January 8, 2014.

In a separate case, Laverdiere Construction Ltd., of Swift Current, pleaded guilty to two charges under occupational health and safety legislation and was fined $1,040 in Swift Current Provincial Court on January 8, 2014.

The charges relate to inspections in Swift Current on May 2, 2012 and June 18, 2012, where an Occupational Health and Safety (OHS) Officer observed workers at a construction site without appropriate fall protection equipment and headwear.  One additional charge against each company was stayed.

Both companies pleaded guilty to:

  • contravening section 116 of the regulations (failure to ensure that workers used a fall protection system at a work area where a worker may fall three metres or more) and were fined $600 each with a $240 surcharge; and 
  • contravening section 91 of the regulations (failure to ensure that workers wear approved industrial protective headwear) and were fined $150 each with a $50 surcharge.

In an unrelated matter, Integral Construction Ltd., of Moose Jaw, pleaded guilty to one count under occupational health and safety legislation and was fined $800 in Moose Jaw Provincial Court on January 8, 2014.

The business pleaded guilty to:

  • contravening section 116 of the regulations (failure to ensure that workers use a fall protection system where a worker may fall three metres or more) and was fined $600 with a $200 surcharge.

The charge stemmed from an inspection on May 3, 2012 where OHS Officers observed workers on a condo roof in Moose Jaw, working without fall protection equipment.  Two other charges were withdrawn.

OHS conducts approximately 4,000 worksite inspections annually to ensure standards are known, understood and enforced.
