MOOSE JAW COMPANY AND NORTH BATTLEFORD BUSINESS OWNER GUILTY OF OCCUPATIONAL HEALTH AND SAFETY VIOLATION

Released on October 30, 2013

Fine Line Builders Ltd., of Moose Jaw pleaded guilty to three charges under The Occupational Health and Safety Regulations, 1996 and was fined $2,520 in Moose Jaw Provincial Court on October 21, 2013.

The company pleaded guilty to:

  • contravening section 116(2)(a) of the regulations (failure to ensure that workers used a fall protection system at a work area where a worker may fall three metres or more);
  • contravening section 192(1)(a) of the regulations (failure to ensure an aerial device, elevating work platform or personnel lifting unit is designed, constructed, erected, operated and maintained in accordance with an approved standard as required); and
  • contravening section 154(2) and 154(3)(a) of the regulations (failure to ensure that only trained operators are required or permitted to operate powered mobile equipment and that said training is provided to competent persons).

The charges stemmed from an incident on February 28, 2012 where an Occupational Health and Safety (OHS) Officer observed two workers at a worksite in Moose Jaw on an aerial platform not using a fall protection system.  Two additional charges were withdrawn.

In a separate case, Matt Marchewski, owner of Matt Marr Custom Homes, pleaded guilty to two counts under The Occupational Health and Safety Regulations, 1996 and was fined $1,040 in North Battleford Provincial Court on October 24, 2013.

Mr. Marchewski pleaded guilty to:

  • contravening section 192 of the regulations (failure to use a personal fall arrest system when being raised or lowered by an aerial device or elevating work platform); and
  • contravening section 91of the regulations (failure to use appropriate protective headwear).

The charges relate to an incident on May 3, 2012 where OHS Officers observed a worker at a residential construction site near Battleford, violating occupational health and safety regulations.

OHS conducts approximately 4,000 worksite inspections annually to ensure standards are known, understood and enforced.  OHS has a zero tolerance approach to violations of fall protection.
