Manitoba Business Guilty of Unsafe Worksite

McDiarmid Lumber Ltd., of Winnipeg has pleaded guilty to one count under the Occupational Health and Safety (OHS) Act for failure to ensure that a worksite that was not under the direct or complete control of the employer was safe for workers.  The company was fined $2,800 in Saskatoon Provincial Court on April 10, 2013.

The conviction is related to an incident which occurred in Saskatoon on December 23, 2010 on a residential worksite at which McDiarmid Lumber Ltd. was the contractor.  A worker employed by a sub-contractor was injured when he fell off a roof onto an air compressor.  Two other charges against McDiarmid Lumber Ltd. were stayed.

Occupational Health and Safety has a zero tolerance policy for any failure to comply with fall protection and recommends prosecution whenever failure to comply with fall protection regulations is observed.
