Lack of Safety Equipment Results in OHS Fines

Two Saskatchewan companies pleaded guilty to occupational health and safety violations for failing to ensure workers were using proper safety equipment.

Hilltop Construction Ltd. of Balgonie pleaded guilty to contravening subsection 116(2) of the regulations (fail to ensure that workers use a fall protection system at a work area where a worker may fall three metres or more).

The company was fined $1,250 plus a $500 surcharge in Regina Provincial Court on September 6, 2017.  One additional charge was stayed.

The charge resulted from a worksite inspection that took place on November 18, 2016.  An occupational health officer observed workers not using fall protection or personal protective equipment.  Fortunately, no one was injured.

In an unrelated matter, Graham G. Lamb of Canora pleaded guilty to:
  • contravening section 91 of the regulations (fail to ensure that workers wear approved industrial headwear); and
  • contravening subsection 116(2) of the regulations (fail to ensure that workers use a fall protection system at a work area where a worker may fall three metres or more).
One additional charge was stayed. Lamb was fined $1,000 plus a $400 surcharge on each count, for a total of $2,800, in Canora Provincial Court on September 7, 2017.

Charges resulted from a worksite inspection on June 15, 2016.  An occupational health officer observed workers not using proper personal protective equipment.  Fortunately, no one was injured.

According to the Workers’ Compensation Board, 15 people died as a result of residential and commercial construction injuries in the past five years.  Proper training and personal protective equipment save lives.
