Organized Hamlet Boundary Alteration

An organized hamlet (OH) may wish to alter its boundaries to add or remove land from its area. An application for boundary alteration cannot be made by an OH. It must work co-operatively with its rural municipal (RM) council.

Section 61 of The Municipalities Act allows the Minister to issue an order that will alter the boundaries of an OH.

Process

The OH board should first discuss the option of altering its boundary with the RM council and any affected landowners. It is recommended that a public meeting be held to discuss the proposal and answer questions from those affected by the proposed change.

A proposal for the OH boundary alteration must be submitted by the RM either using the online Land Planning and Development Application or by mail. The following documentation should be submitted to request a boundary change of an OH:

  1. A motion from the OH board to alter the boundary;
  2. A complementary supporting resolution from the RM council;
  3. A brief explanation of the reasons for the proposed boundary alteration;
  4. A summary of public meetings, minutes from those public meetings, any submissions received by council, and evidence of notice;
  5. A map of the proposed boundary alteration; and
  6. The legal land description of the proposed boundary changes.

The Minister may issue an order causing the alteration if the Minister is of the opinion that the boundary alteration will not affect the viability of the OH and/or the RM. The order will state the effective date of the boundary change and will describe the new boundary of the OH.

From the effective date of the order, all previous boundary description orders are repealed and the new boundary description is deemed to be the legal description of the OH.
