Two Saskatchewan Companies and Company Supervisor Prosecuted for Safety Violations

On February 11, 2015, 101221752 Saskatchewan Ltd., operating as Integral Construction, of Moose Jaw pleaded guilty to two counts under Occupational Health and Safety (OHS) legislation.
The Court imposed a fine of $1,680.

Integral Construction pleaded guilty:
  • for failing to ensure that workers wear approved industrial protective headwear; and
  • for failing to require a worker to use a personal fall arrest system that meets the requirements of Part VII, while permitting a worker to work from a platform held in an elevated position.
One other charge was stayed.

In addition, Shane Kilmer, supervisor at 101221752 Saskatchewan Ltd., operating as Integral Construction, was also charged and pleaded guilty for contravening clause 3.1(b) of the Act for failing to ensure that a worker under his direction complied with The Occupational Health and Safety Act, 1993 and its regulations.  He was fined $840.  One other charge was stayed.

Charges were laid after a routine inspection in Moose Jaw on August 9, 2013.  An Occupational Health Officer observed a worker working from the forks of an all-terrain forklift while standing on oriented strand board.  During the same inspection, the officer also observed two other workers working without head protection.

In another case, Native Co-ordinating Council of Prince Albert pleaded guilty to one count under OHS legislation in Prince Albert Provincial Court on February 5, 2015.  Native Co-ordinating Council pleaded guilty to a charge of failing to provide the Occupational Health Officer, who issued a Notice of Contravention, with a written report of progress that has been made toward remedying each contravention of the Act or regulations that is stated in the notice.  The company was fined $840.
