Two Individuals Fined for Safety Violations

Released on March 12, 2014

Mike Engel, operating as Engel Construction, of Regina pleaded guilty to three counts under occupational health and safety legislation and was fined $1,240 in Regina Provincial Court on March 5, 2014.

Engel pleaded guilty to:
  • contravening section 116 of the regulations (failure to ensure that a worker at a work area use a fall protection system at a work area where a worker may fall three metres or more) and was fined $600 with a $240 surcharge;
  • contravening section 91 of the regulations (failure to require a worker to use approved industrial protective headwear) and was fined $150 with a $50 surcharge; and
  • contravening section 253 of the regulations (failure to ensure that a portable ladder extends at least one metre above any platform, roof or other landing to which the ladder is used as a means of access) and was fined $150 with a $50 surcharge.
The charges stem from an inspection by an Occupational Health and Safety Officer who observed a worker violating occupational health and safety laws at a residential construction site in Regina.  Two other charges were stayed.

In a separate matter, Jason Rolleston, operating as TJR Construction, of Saskatoon pleaded guilty to one charge under occupational health and safety legislation and was fined $840 in Saskatoon Provincial Court on February 13, 2014.

Rolleston pleaded guilty to:
  • contravening section 116 of the regulations (failure to ensure that workers use a fall protection system at a work area where a worker may fall three metres or more) and was fined $600 with a $240 surcharge.
The charges stem from an inspection by an Occupational Health and Safety Officer at a worksite in Saskatoon.  Workers were observed on a roof without utilizing fall protection equipment.

Occupational Health and Safety conducts worksite inspections to ensure standards are known, understood, and enforced.  Falls represent over 12 per cent of all injuries reported in construction.
