Moose Jaw Roofing Company Fined for OHS Violations

Released on July 29, 2014

Tip Top Roofing Ltd. pleaded guilty to three counts under occupational health and safety legislation and was fined $2,700 in Moose Jaw Provincial Court on July 23, 2014.

The company pleaded guilty to:
  • contravening section 116 of the regulations (failing to ensure that workers use a fall protection system where a worker may fall three metres or more);
  • contravening section 91 of the regulations (failing to ensure that workers wear approved industrial protective headwear as required); and 
  • contravening section 17 of the regulations (failing to ensure that all work at a place of employment is sufficiently and competently supervised).
Two other charges were withdrawn by the Crown.

The charges stemmed from an inspection that took place on April 2, 2013 in Moose Jaw.  An Occupational Health Officer, who was on-site in response to a complaint, observed workers who were not using fall protection and other protective equipment.

The Ministry of Labour Relations and Workplace Safety recommends prosecutions where individuals or companies refuse to comply with the provisions of legislation or where significant risk of injury to workers is present as a result of non-compliance.
