PRINCE ALBERT COMPANY FINED FOR IMPROPER TRENCHING

Released on June 13, 2012

Dmyterko Enterprises Ltd., of Prince Albert, has pleaded guilty to one count under Occupational Health and Safety (OHS) legislation, related to a failure to ensure that a worker was protected from cave-in or sliding materials in a trench. The company was fined $4,200 in Prince Albert Provincial Court.

The conviction related to an incident that took place on February 16, 2011, at the Opawikoscikan Education Center in Prince Albert. Two workers were observed in a trench that was not properly sloped and had been undercut to locate a gas line. Workers were not protected from cave-ins or sliding material by means of cut back or shoring. Two other charges against Dmyterko Enterprises Ltd. were stayed.

In relation to the same incident, three charges against a supervisor, Harvey Delisle of Dmyterko Enterprises Ltd., were dismissed.

OHS conducts approximately 4,500 worksite inspections annually to ensure standards are known, understood and enforced, and investigates where workers are killed or seriously injured in a work related incident.
